Terms of Service & Mentoring Policies

Last updated: October 2026 · Governing law: Victoria, Australia

1. Commercial Entity & Service Agreement

Britt's English Club ("we", "us", "our") is operated by Brittany as an independent mentoring practice (Sole Trader based in Melbourne, Victoria, Australia; ABN registration pending / available on request). We provide personalised 1:1 English speaking coaching and fluency mentoring for intermediate to advanced learners.

By purchasing a mentoring package or booking a session through our website, you enter into a legally binding contract governed by the laws of Victoria, Australia, and agree to these Terms of Service.

2. Session Delivery & Technology Requirements

All standard sessions run for 60 minutes (1 hour) and take place live online via Google Meet. Scheduling is managed directly through your Student Dashboard using our automated calendar integration. You are responsible for ensuring adequate broadband internet connectivity and functioning audio/video hardware for every scheduled session.

⏱️

3. Notice Policy, Rescheduling Allowance & Cancellations

To maintain schedule predictability and respect calendar availability:

  • Autonomous Rescheduling Allowance: Each logical session includes up to two (2) autonomous reschedules directly through your student dashboard, provided the required notice window is met.
  • Exceptional Third Reschedule: A third reschedule request requires Britt's prior manual approval through the dashboard request tool and cannot be executed automatically through the calendar.
  • Notice Window: Multi-session packages require at least 24 hours notice prior to the scheduled start time. Single one-off sessions require at least 48 hours notice. If cancelled or rescheduled with less than the required notice, the session credit is consumed and forfeited.
  • Changes Initiated by Britt: If Britt needs to move a session due to illness or an unavoidable emergency, that change will never deduct from your reschedule allowance or compromise your session credit validity.
⏰

4. Attendance & 10-Minute Punctuality Window

Britt will wait in the designated Google Meet room for 10 minutes past the scheduled start time. If you have not joined by the 10-minute mark and have not provided prior written notice, the session is officially marked as a completed No-Show and the credit is forfeited to compensate for the mentor's reserved time.

5. 6-Week Credit Validity & Repurchase Renewal

Mentoring package credits (Confidence Build and Speaking Confidence Reset) are designed as focused, high-impact speaking sprints and carry a 6-week (42-day) validity window from the date of confirmed payment.

  • Renewal Upon Repurchase: If you purchase another eligible package while holding active remaining credits, the validity of your existing eligible balance is automatically extended to align with your newest package's 42-day window.
  • One-Off Sessions Excluded: Single 1-on-1 one-off sessions carry individual validity and are strictly excluded from rolling renewal rules.
  • Expiry: Unscheduled credits remaining past their validity window expire permanently and cannot be retroactively redeemed or refunded.

6. Cancellation, Refunds & Australian Consumer Law (ACL)

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

Mentoring credits represent reserved professional calendar capacity. We do not provide discretionary refunds for change of mind or personal schedule conflicts once payment has been confirmed.

Nothing in these Terms excludes, restricts, or modifies any statutory consumer guarantees under the ACL. If there is a major failure with our service (e.g. an inability on our part to deliver the paid sessions), you are entitled to cancel your service contract and receive a proportional refund or replacement session in accordance with Australian law.

7. Teen Learners (13–17 Years) & Guardian Supervision

Britt's English Club accepts teenage learners aged 13 to 17 strictly under the contracting authority of a parent or legal guardian:

  • The adult parent or guardian must be the registered account holder and contracting party responsible for payments and scheduling.
  • All sessions involving teenage learners must be conducted in an environment accessible to and supervised by the parent or guardian.
  • We do not offer autonomous minor accounts or accept learners under 13 years of age.

8. Safe Learning Environment & Strict Recording Prohibition

To foster an uninhibited, relaxed space for conversational practice, mentoring sessions are never recorded or transcribed by us. Students and guardians agree not to record, screenshot, or distribute audio or video of sessions without prior written consent.

9. Pricing, Currency & GST Treatment

All prices are denominated in Australian Dollars (AUD) and processed as one-time payments via Stripe. As the mentoring entity's annual commercial turnover is currently below the Australian Taxation Office (ATO) statutory registration threshold of \$75,000 AUD, prices are net and GST-free (not subject to 10% GST). There are no recurring subscriptions or surprise recurring billing.

10. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of the State of Victoria, Australia. The parties irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.

11. Questions & Contact

If you have questions regarding these terms, urgent rescheduling matters, or require assistance, please contact Britt directly at support@brittsenglishclub.com.
